3. Booking completion and payment

Upon receipt of the booking confirmation, a first payment of 30% is to do to Moijama S.L. within 3 working days. The booking is confirmed after receipt of the payment.

 

The remaining payment will be made on the day of arrival.

 

4. Change of booking

Travel duration and dates can be changed depending on availability and under considering to the cancellation policy free of charge. Rebooking’s must be made in written form.

 

5. Cancellation

Cancelled (announces) the tenant the contract before the rental period, without naming a new tenant who enters into the contract on the same terms, are as compensation after deducting the expenses saved, the following prorated rent (excluding cleaning) is payable unless a redeploying rental is not possible:

- Until 49 days before arrival: 10% of rental

- Until 35 days before arrival: 30% of rental

- Up to 21 days before arrival: 60% of rental

- Until 14 days before arrival: 90% of rental

- Otherwise (less than 14 days before arrival) 100% of rental.

 

Nevertheless, the owner is trying to rent the property.

 

Cancel the tenant to stay off prematurely, he remains obligated to pay the full rental price.

 

A cancellation or termination must be in written form. Decisive is the date of receipt of the declaration by the owner.

 

In view of this possible case, the owner recommend that the tenant have a travel insurance.

 

The rental property including the furniture and the other items are be treated with care. The tenant has to advice accompanying and / or visiting people to be careful. The tenant is liable for damages to the rented property, furniture or other items in the property by him or his accompanying persons.

 

Defects that result from the acquisition of the rental property and / or during the rental period must reported to the lessor immediately in an appropriate manner.

 

6. Inquiry form

Any request from the user through the website of Moijama, S.L. . is without obligation and does not constitute an offer to conclude a contract. Moijama, S.L. creates a non-binding offer based on the request form and sends it to the email address given by the user. If the user receives this from Moijama S.L. and accepts the offer, a contract is concluded between the user and Moijama S.L.

 

7. Force majeure

For the consequences of force majeure Moijama S.L. is not liable under this contract. These include war, internal disturbances, issued by authorities, terrorist attacks, fires, floods, storm, other natural disasters, blackouts, accidents, strikes, lockouts or other industrial action, of which the services of Moijama S.L. or its suppliers may be affected.

 

8. Liability of Moijama S.L.

Moijama S.L. is effort to ensure that the information on the website, software and other data, particularly with regard to availabilities, restrictions and prices is complete and correct. All presented services on the website are limited. Incidentally Moijama S.L. only take over the liability in cases of intent or gross negligence, and for acquired and guarantees for breach of contract.

In the case of any dispute concerning the fulfilment and implementation of this contract, the parties of this contract agree expressly submit to the jurisdiction of the judicial authorities of the Province of Santa Cruz de Tenerife and expressly waiving any other jurisdiction that may correspond to them.

 

18. Legal regulation
